These Terms and Conditions of Sale ("Terms") govern any purchase made on the MonsterMine website. By placing an order, you confirm that you have read and accepted them without reservation.

1. Legal notice

MonsterMine, a French SARL (limited liability company) with declared share capital, registered under SIRET number 938 781 614 00020, whose registered office is located at 61 rue de Lyon, 75012 Paris, France ("MonsterMine" or "we").

2. Purpose and scope

The MonsterMine website (www.monstermine.io) allows the purchase of digital content related to the MonsterMine game universe, including egg boxes ("Egg Carton"), MonsterMine creatures, cosmetic items and associated tokens ("NFTs"), recorded on the Solana blockchain. These Terms apply to any order placed by a customer ("you", "the Customer") on the site, regardless of the payment method used.

3. Products and description

The products offered for sale are digital assets (non-fungible tokens, or "NFTs") associated with creatures, items, or boxes to be opened within the MonsterMine universe. Each product is described on the site with its main characteristics (rarity, contents, price) at the time of purchase. Visuals and animations are provided for illustrative purposes; slight variations may exist between the presentation and the final, randomly generated result (stats, appearance).
MonsterMine is not a financial product. NFTs and associated tokens are not intended to constitute an investment or a promise of return. Their value, if any exists on a secondary market, is freely set by supply and demand and may fluctuate significantly, including down to zero. The Customer acknowledges understanding the risks inherent to digital assets and blockchain technology prior to any purchase.

4. Price and payment

Prices are shown in US dollars (USD) or in crypto-asset equivalent (SOL, USDC) depending on the chosen payment method, tax included where applicable. MonsterMine reserves the right to change its prices at any time; the applicable price is the one displayed at the time of order.
Payment can be made either by credit card via our provider Stripe, or directly in crypto-assets (SOL or USDC) from the Customer's connected Solana wallet. The order is only confirmed once payment has been effectively received by MonsterMine or the transaction validated on the blockchain.

5. Delivery

Digital products are delivered immediately after payment confirmation, by generating ("minting") the corresponding NFT directly to the Customer's connected Solana wallet, or by making it available in their "Collection" area on the site. No physical delivery time applies, as this is digital content not supplied on a tangible medium.

6. Right of withdrawal — immediate performance and waiver

Under French consumer law (Article L221-18 of the French Consumer Code), consumers generally have a 14-day right of withdrawal for online purchases.

However, under Article L221-28 13° of the French Consumer Code, this right does not apply to the supply of digital content not provided on a tangible medium, the performance of which has begun after the consumer's prior express consent and express waiver of their right of withdrawal.

As our products are delivered immediately (see Article 5), the Customer is asked, before each purchase, to tick a confirmation box by which they:
  a) expressly request the immediate execution of the order, without waiting for the withdrawal period to end; and
  b) acknowledge that they lose their right of withdrawal once digital delivery has begun.

Without this express confirmation, the order cannot be completed. A record of this confirmation (date, product concerned) is kept and can be viewed by the Customer from their Profile area.

7. Refunds and special cases

Given the waiver of the right of withdrawal described in Article 6, MonsterMine is not obligated to issue a refund once an order has been fulfilled. As a commercial gesture and without obligation, MonsterMine may, at its sole discretion and after reviewing a justified request (clear ordering error, duplicate charge, proven technical malfunction attributable to the site), deactivate the NFT(s) concerned using their unique identifier, without this constituting an acknowledgment of a right to a refund or a precedent for other requests.
Deactivation does not remove the NFT from the player's wallet, and they remain its owner on the blockchain. It only suspends the MonsterMine's effects inside the game.

8. Intellectual property

All elements of the MonsterMine website (text, visuals, logos, animations, characters, graphic identity) are protected by intellectual property law and remain the exclusive property of MonsterMine or its licensors. The purchase of an NFT grants the Customer a right of use of the associated content within the MonsterMine universe, without transferring intellectual property rights over the underlying creations, unless explicitly stated otherwise.

9. Liability

MonsterMine takes reasonable measures to ensure the proper functioning of the site and the security of transactions, without guaranteeing continuous availability. MonsterMine cannot be held liable for malfunctions related to the Solana network, a third-party wallet (Phantom or other), a Customer handling error, or the volatility of digital assets. The Customer is solely responsible for the security of their wallet and private keys.

10. Personal data

Personal data collected (email address, wallet address) is used strictly for account management, order processing, and customer relations, in accordance with the General Data Protection Regulation (GDPR). The Customer has the right to access, rectify, and delete their data, exercisable via the Contact page.

11. Governing law and disputes

These Terms are governed by French law. In the event of a dispute, an amicable solution will be sought first via the Contact page. Failing an amicable agreement, the competent courts of Paris shall have sole jurisdiction, subject to mandatory rules applicable to consumers.
